Terms and Conditions

Please read these Terms and Conditions carefully. By requesting us to confirm your Bai Tu Long Bay cruise, day trip, transfer or related travel service, you acknowledge that you have read, understood and agreed to the terms below.

1. Prices and Services

All prices are quoted in USD unless otherwise stated and are based on the services, travel dates, cruise category and number of travelers confirmed at the time of booking.

Prices may include accommodation on board, meals, activities, transportation, entrance fees and other services specifically listed in your booking confirmation.

Prices published on our website may change before confirmation due to seasonal rates, supplier adjustments, fuel costs, government charges or availability.

2. Taxes and Additional Charges

Unless otherwise specified, quoted prices include applicable service charges, VAT and government fees included by the cruise operator.

Personal expenses, drinks, travel insurance, visa fees, domestic tourism taxes, port charges or other costs not clearly listed in the itinerary are excluded.

Any government-imposed tax or fee changes may result in an adjustment to the booking price.

3. Booking Deposit and Payment

A 30% deposit of the total booking value is required to confirm the reservation. The deposit is non-refundable unless otherwise stated in writing.

The remaining balance must be paid at least 20 days before the scheduled departure date.

For bookings made within 20 days of departure, full payment may be required at the time of confirmation.

Additional charges may apply for credit card payments, urgent bookings, private transfers, special meals, room upgrades or other requested services.

3.1 Credit Card Payments

We accept Visa, Mastercard and American Express. Credit card processing fees may apply.

3.2 Bank Transfers

Bank transfer instructions will be provided by our travel consultant after the booking details have been confirmed.

4. Cancellation and Refunds

4.1 Cancellation by the Traveler

Cancellation charges apply as follows:

  • More than 21 days before departure: the deposit is retained to cover administration and supplier charges. Any remaining balance may be credited for future travel, valid for one year from the date of payment.
  • 15–21 days before departure: 50% of the total booking value is charged.
  • 1–14 days before departure: 100% of the total booking value is charged.
  • No-show or failure to join the cruise or tour: 100% of the total booking value is charged.

Cancellation policies may vary between cruise operators and suppliers. If a supplier’s specific cancellation policy is stricter than these terms, the supplier’s policy will apply and will be advised before confirmation wherever possible.

We strongly recommend purchasing travel insurance that includes cancellation, medical expenses and emergency assistance.

4.2 Cancellation or Modification by Us or the Cruise Operator

Cruise schedules and itineraries may be changed, postponed or cancelled due to weather, storms, port restrictions, government regulations, safety concerns or other circumstances beyond our control.

If the cruise operator cancels the service, we will offer an alternative date, an alternative service or a refund according to the amount received from the relevant supplier.

We are not responsible for additional costs caused by flight changes, hotel extensions, meals, transportation or other arrangements resulting from a cruise cancellation or delay.

5. Weather and Safety Regulations

Cruises in Bai Tu Long Bay operate under the regulations of the local port authorities and maritime authorities.

In the event of bad weather, storms, fog or other safety concerns, the authorities may restrict, shorten or cancel the cruise without prior notice.

The final decision regarding sailing, route changes, kayaking, swimming, cave visits and other activities rests with the cruise operator and the relevant authorities.

6. Unused Services

No refund or exchange will be provided for accommodation, meals, transfers, activities, sightseeing or other services included in the booking but not used by the traveler.

This includes late arrival, early departure, missed transfers, voluntary changes to the itinerary or failure to participate in scheduled activities.

7. Passports and Travel Documents

Travelers must carry a valid passport or accepted travel document. For most international travelers, the passport should be valid for at least six months from the date of entry into Vietnam and contain sufficient blank pages.

Travelers are responsible for checking the entry requirements applicable to their nationality before arrival.

8. Visas

Vietnam visa and entry requirements are the traveler’s responsibility. Travelers should obtain the correct visa or visa exemption before departure.

We may provide visa assistance where requested, but approval remains subject to the decision of the relevant Vietnamese authorities.

9. Travel Insurance

Travel insurance is strongly recommended. The policy should cover medical treatment, emergency evacuation, trip cancellation, delays, baggage loss and cruise cancellation caused by weather or other unexpected events.

10. Health and Fitness

Travelers should inform us of any medical condition, disability, allergy, dietary requirement or mobility limitation before booking.

Cruise activities may include boarding small boats, walking on uneven surfaces, climbing steps, kayaking, swimming and visiting caves. Travelers should ensure that they are physically able to participate safely.

Children must remain under the supervision of their parents or accompanying adults at all times.

11. Accommodation on Board

Cabin categories, bed arrangements, cabin locations and views are subject to availability and confirmation by the cruise operator.

Special requests such as connecting cabins, twin beds, double beds, specific cabin locations, non-smoking cabins or accessibility arrangements cannot be guaranteed unless confirmed in writing.

Triple and family cabins may include an extra bed or sofa bed and may offer less space than standard double cabins.

12. Meals and Dietary Requirements

Meals included in the booking are provided according to the cruise program.

Special dietary requirements, allergies and food preferences must be advised at the time of booking. Although we will pass the information to the cruise operator, special requests cannot always be guaranteed.

13. Transfers and Transportation

Transfers between Hanoi, the port and other destinations are provided only when specifically included in the confirmed itinerary.

Transportation is operated by licensed drivers and transport providers. Pick-up times may change because of traffic, weather, road conditions or operational requirements.

Travelers must provide accurate hotel, flight and contact details before travel.

14. Activities and Personal Belongings

Kayaking, swimming, cave visits, fishing village visits and other activities are subject to weather, water conditions, safety regulations and the cruise operator’s decision.

Travelers participate in activities at their own risk and must follow the instructions of the guide and crew.

My Way Travel and its suppliers are not responsible for loss, theft or damage to personal belongings. Valuables should be stored securely.

15. Complaints and Customer Assistance

Any concern regarding the cruise, cabin, meals, transfers or other services should be reported immediately to the cruise staff, guide or our local representative so that reasonable assistance can be provided during the trip.

Complaints submitted more than 14 days after completion of the service may be difficult to investigate.

16. Licenses and Permits

Cruise operators, transport providers, guides and other service providers are required to comply with applicable licensing, safety and operating regulations in Vietnam.

17. Force Majeure

We are not responsible for failure, delay, cancellation or changes caused by events beyond our reasonable control, including storms, typhoons, floods, extreme weather, port closures, government restrictions, epidemics, strikes, war, civil unrest, technical problems or other unforeseeable circumstances.

18. Liability

Bai Tu Long Bay and its booking partners act as an intermediary between travelers and cruise operators, hotels, transport companies, guides and other service providers.

We are responsible for arranging the services confirmed in the booking but are not responsible for the independent acts, omissions, delays or decisions of third-party suppliers.

Cruise routes, schedules, activities and ports of call are provisional and may change for operational or safety reasons.

19. Governing Law

These Terms and Conditions are governed by the laws of Vietnam. Any dispute will first be addressed through good-faith negotiation. If the dispute cannot be resolved, it may be referred to the competent courts or arbitration authorities in Vietnam.

20. Changes to These Terms

These Terms and Conditions are valid from the date of publication and may be updated from time to time without prior notice. The terms applicable to your booking are those provided or accepted at the time your reservation is confirmed.
